Terms of Service — Cast Helper

1. Acceptance of Terms

By accessing or using Cast Helper ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Cast Helper is a podcast production tool that provides automated transcription, AI-generated show notes, talking points, social media posts, and tags for podcast episodes. The Service integrates with third-party providers including AssemblyAI for transcription and OpenAI for content generation.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering and keep it up to date.

4. Subscriptions and Billing

Paid features of the Service are billed on a monthly subscription basis. You may try the Service with one episode at no cost before subscribing. Subscription fees are charged in advance and are non-refundable except as required by law. We reserve the right to change pricing with reasonable notice.

Payment processing is handled by Stripe. By subscribing, you agree to Stripe's terms of service. Your subscription will automatically renew unless cancelled before the renewal date.

5. Your Content

You retain ownership of all audio files and other content you upload to the Service ("Your Content"). By uploading content, you grant Cast Helper a limited licence to process it solely for the purpose of providing the Service to you.

You are solely responsible for ensuring you have the right to upload and process any audio content. You must not upload content that infringes third-party intellectual property rights or violates any applicable law.

6. Acceptable Use

You agree not to use the Service to:

Upload content you do not have rights to process
Attempt to circumvent plan limits or billing
Reverse engineer or attempt to extract the underlying AI models
Use the Service in any way that violates applicable laws or regulations
Resell or redistribute the Service without authorisation

7. AI-Generated Content

The Service uses AI to generate transcriptions and written content. AI-generated output may contain errors, inaccuracies, or omissions. You are responsible for reviewing and editing all generated content before publication. We make no warranties regarding the accuracy or completeness of AI-generated output.

8. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend or discontinue the Service, or any part of it, at any time for maintenance, upgrades, or other operational reasons. We will provide reasonable notice of planned downtime where possible.

9. Limitation of Liability

To the fullest extent permitted by law, Cast Helper shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid in the three months preceding the claim.

10. Termination

You may cancel your account at any time from your billing settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your access to the Service will cease and your data may be deleted after a reasonable retention period.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
